These Terms of Service govern your use of tacticalferux.top and the mobile games published by RICHARD A. H. MORRIS LIMITED under the Tactical Ferux brand. In these Terms, “we,” “us,” and “our” refer to RICHARD A. H. MORRIS LIMITED, and “Services” means this website and the games to which these Terms apply.
Please read these Terms before using the Services. By using the Services, you agree to these Terms to the extent an agreement may lawfully be formed in this way. If you do not agree, please do not use the Services. Nothing in these Terms removes any mandatory rights you have under applicable law.
1. Our Services
Tactical Ferux is a collection of mobile puzzle games. The website introduces the games and provides game information, download links where available, and support contact details. Games are downloaded and installed on a compatible mobile device; they are not played in the website.
These Terms apply to Rank Shift (com.nexbit.rankshift), Step Cage (com.movecap.stepbound), and any additional game that expressly refers to these Terms. Our games are offered free of charge and are primarily supported by advertising displayed inside the games.
Device requirements, availability, and distribution may vary by game, region, and app store. You are responsible for your device and internet connection, including any charges imposed by your mobile or internet provider.
2. Eligibility and Minors
The Services are intended for a general audience and are not specifically directed to children under 13. You must meet the applicable age requirements for the game and the app store through which you obtain it.
If you are below the age at which you can independently enter into an agreement under applicable law, a parent or legal guardian must review these Terms and provide any permission required by that law before you use the Services. Privacy and parental-consent requirements are described in our Privacy Policy.
3. Permission to Use the Games
Subject to these Terms, we grant you a limited, non-exclusive, personal, non-commercial license to install and use an authorized copy of a game on a device you own or control. This permission continues while you comply with these Terms, unless ended as described in the Suspension and Ending Use section.
The game software and its content are licensed, not sold. You may make copies only as needed for permitted use or as otherwise allowed by applicable law. Any separate game license or app-store terms presented to you may also apply. If a separate game license expressly addresses a particular issue differently, that license applies to that issue for that game, subject to your mandatory rights.
4. Acceptable Use
You must use the Services lawfully and respect the rights of others. You must not:
- Introduce malware, disrupt the Services, or attempt to gain unauthorized access to systems or data;
- Use automated tools, exploits, or other methods to generate fraudulent advertising events or manipulate the operation of the Services;
- Copy, distribute, sell, rent, or commercially exploit the games or their content without permission, except where applicable law permits;
- Reverse engineer or bypass technical protections, except to the extent you have a right to do so under applicable law;
- Infringe intellectual property, privacy, or other rights, or impersonate another person or organization.
These restrictions do not limit any rights that applicable law gives you to use, examine, or adapt software.
5. Advertising and External Services
Our games may display advertisements supplied by advertising or mediation providers. Ad availability and content may vary. Our Privacy Policy describes advertising-related information processing and the choices and rights available to you.
Using a game does not by itself provide consent to personalized advertising where separate consent is required. Where required by law, personalized advertising will only be enabled after the necessary consent has been obtained. Declining personalized advertising may still result in contextual or non-personalized ads.
Advertisements, app-store listings, and links may lead to services operated by third parties. Those providers set their own terms and privacy policies. Displaying an advertisement or link is not an endorsement of the advertised product or service. Review the provider’s information before interacting with it. This does not reduce our responsibility for our own conduct or any rights you have under applicable law.
6. Game Progress and Local Data
Games may store progress, scores, completed levels, preferences, or settings on your device. Where that information is stored only locally, we may not have access to it and may be unable to recover it.
Clearing app storage or uninstalling a game may permanently remove local progress and settings. A change of device may also make locally stored data unavailable. Use any backup or transfer options expressly provided by the game or your device before removing data. These Terms do not promise cloud backup or synchronization where the game does not provide those features.
7. Intellectual Property
The games, software, artwork, screenshots, text, names, and website design are owned by us or the relevant rights holders and may be protected by intellectual property laws. Except for the permission expressly given in these Terms or rights available under applicable law, no ownership or other rights are transferred to you.
Third-party names and materials remain the property of their respective owners. For permission requests or concerns about content, contact jake@jacksonembercommercellc.space.
8. Privacy and Support
Our Privacy Policy explains how information may be processed in connection with the website, games, advertising, and support communications. It also explains how to submit privacy or deletion requests. Read it alongside these Terms.
For support, email jake@jacksonembercommercellc.space and identify the relevant game. Please include only information needed to explain the issue and do not send passwords or unnecessary sensitive information.
9. Availability, Updates, and Changes
We may update the Services to fix errors, improve performance, maintain security, respond to legal requirements, or develop gameplay. Access may be interrupted for maintenance or events outside our reasonable control. We do not promise that every device or operating-system version will remain supported indefinitely.
We will take reasonable care in operating the Services. If we plan a change that materially reduces an existing service or ends its availability, we will provide reasonable advance notice through the website, the game, or another appropriate channel where practicable, unless urgent security or legal reasons prevent this. Any rights or remedies required by applicable law remain available.
10. Responsibility and Your Legal Rights
The games are provided for entertainment. We do not promise that they will be error-free or continuously available. If something is not working as described, contact us so that we can consider the issue and any remedy required by applicable law.
We are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence of the breach or if both you and we could reasonably have anticipated it when the agreement was made. Where applicable law does not permit this limitation, that law applies.
The Services are intended for personal use. We do not accept responsibility for business losses arising from commercial use that these Terms do not permit, to the extent applicable law allows that exclusion.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer rights, including any rights relating to defective digital content or services, remain unaffected.
11. Suspension and Ending Use
You can stop using the website or uninstall a game at any time. Uninstalling a game may remove locally stored data, as described above. Privacy requests are handled under the Privacy Policy.
We may restrict access to an affected service or end the permission granted by these Terms if you seriously or repeatedly breach them, if continued access creates a security risk, or if we are legally required to do so. Where reasonable and practicable, we will explain the reason and allow you an opportunity to correct the issue before acting, unless immediate action is necessary.
Contact us if you believe a restriction was applied in error. Ending use does not remove rights or obligations that arose before termination, or provisions concerning intellectual property, responsibility, privacy, and dispute resolution that by their nature continue to apply.
12. Applicable Law and Disputes
These Terms are subject to the law that applies to your relationship with us under the relevant conflict-of-law rules. They do not deprive you of mandatory protections available under the laws of your country of residence.
If a dispute arises, you may contact jake@jacksonembercommercellc.space so that we can try to resolve it. Contacting us is not a condition of bringing a claim and does not restrict any right to contact a regulator or seek a legal remedy.
You and we may bring proceedings before a court that has jurisdiction under applicable law. These Terms do not require binding arbitration, waive participation in a collective claim, or require you to use a foreign court where applicable law gives you the right to use your local courts.
13. Changes to These Terms
We may revise these Terms when our Services or legal requirements change. The revised text will be posted on this page. For a material change, we will provide appropriate notice and state when it takes effect, and seek agreement where required by law.
Changes do not apply retroactively to an existing dispute or remove rights that have already arisen. If you do not agree to a change, you may stop using the affected Services without losing rights or remedies already available to you.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not by itself waive the right to enforce it later.
